The DMV Regulatory Agenda is a list of Regulations that the DMV plans to change during the year 2026. New York State law does not require the DMV to make all of the proposed changes on the Regulatory Agenda. The document lists changes that the DMV has considered, but the document can be amended if there are changes in law or in the requirements of the DMV.

The DMV can recommend and make changes to the regulations that do not appear in the current Regulatory Agenda. The DMV will update the regulatory Agenda as other proposed changes are considered.

Regulatory Agenda - New York State Department of Motor Vehicles 2026

Pursuant to section 202-d of the State Administrative Procedure Act, the Department of Motor Vehicles presents its regulatory agenda for 2026.  All references are to Title 15 of the New York Code of Rules and Regulations.  The Department reserves the right to add, delete or modify any item presented in this agenda.

  1. Part 2 – Amend Part 2 to harmonize requirements for driver education in high schools and colleges.
  2. Part 3 – Amend Part 3 to create an escort vehicle license endorsement.
  3. Part 7 – Amend Part 7 to modernize the requirements for driving school operation and enhance consumer protections.
  4. Part 49 – Amend Part 49 to conform to Vehicle and Traffic Law regarding seat belts on charter buses.
  5. Part 76 – Amend Part 76 to modernize the requirements for driving school operation and enhance consumer protections.
  6. Part 77 – Amend Part 77 to include penalties for Private Service Bureaus that violate DMV’s current requirements, to prohibit misleading Private Service Bureau advertising, and to modernize current regulations by eliminating obsolete language.  
  7. Part 78 – Amend Part 78 to prohibit a dealer from selling a vehicle with a prior unresolved lien and address other problematic practices.
  8. Part 79 – Amend Part 79 to update the inspection program.
  9. Parts 91 and 122 – Amend Parts 91 and 122 to modernize the delivery of traffic ticket and conviction information to the Department and to conform with Federal requirements.
  10. Subchapter F– Clarify Subchapter F to require any licensed or registered entity or person to comply with all Commissioner’s Rules and Regulations and the Vehicle and Traffic Law as applicable.
  11. Part 134 – Amend Part 134 to modify the schedule of fees for the Impaired Driver Program.
